Duetto Terms of Use
These are the rules for using Duetto. They’re short on purpose. They’re also the end user licence agreement (EULA) for the app.
The short version
- Duetto is game night for two people who are together. You need to be 16 or older.
- Pair only with someone who wants to be paired. Be kind to each other.
- What you write and draw is yours. You let us store it and show it to your partner so the app works.
- Pro is billed by Apple. One person’s Pro covers both of you while you’re paired.
- You can unpair, block or delete your account whenever you like.
1. Who we are, and what applies
Duetto is published by Mitaanshu Agarwal, a sole trader in Australia. In these terms, “we” and “us” mean Mitaanshu. You can reach us at support@keenshift.ai.
These terms are an agreement between you and us. They add to Apple’s standard Licensed Application End User Licence Agreement (Apple’s EULA), which applies to every App Store app. If the two conflict, Apple’s EULA wins on the licence to use the app, and these terms win on everything else. Apple is not responsible for Duetto and has no duty to support it. Apple’s EULA says more about that.
2. Your licence
We give you a personal, non-exclusive, non-transferable licence to use Duetto on Apple devices you own or control, as Apple’s EULA allows, for your own use. We can end it if you break these terms.
Don’t copy, modify, rent, resell or reverse-engineer the app, except where the law lets you. Duetto, its games, questions and artwork belong to us or the people who license them to us. What you make in Duetto is yours (section 6).
3. Who can use Duetto
- You must be at least 16. If you’re under 16, please don’t use Duetto.
- You must be able to make a binding agreement where you live.
- Duetto is for two people who both want to use it together. It is not for anyone who has been asked, by the other person or by a court, to stay away from them.
4. Your account
- You sign in with Apple, or with a one-time code we email you. Keep your Apple Account and your inbox secure. You’re responsible for what happens under your account.
- Use your own first name, or a nickname you’re happy for your partner to see.
- One person, one account. Don’t share your account.
5. Pairing: both of you, with consent
- Pairing links two accounts with a code or an invite link. Share your code only with the person you want to pair with. It stops working after seven days or once it’s used.
- Don’t pair with someone who hasn’t agreed. Don’t pressure, trick or force anyone to use Duetto, hand over a phone, or share their answers.
- Once you’re paired, your partner can see the things Duetto shows them. The Privacy Policy lists them.
- Either of you can unpair or block the other at any time, for any reason. We won’t ask why. The other person is told you’re no longer paired, not why.
If you feel unsafe, unpair or block, and then talk to someone you trust. In an emergency in Australia, call 000. In Australia, 1800RESPECT (1800 737 732) offers confidential support. Elsewhere, please contact your local emergency or support services.
6. What you put in Duetto
- It’s yours. You keep ownership of your answers, words, drawings, doodles, recordings, photos and notes (your “content”).
- What you let us do. You give us a licence to store, copy, process and display your content, and to show it to your partner the way the app is designed to, for as long as we need to run Duetto. The licence is non-exclusive, worldwide and free. It ends when your content is deleted. The Privacy Policy explains what a partner keeps.
- What you promise. You own your content or have the right to share it, and it doesn’t break the law or anyone else’s rights.
- Sealed answers. Duetto holds your partner’s answer back until you’ve both answered. That is a feature of the app, not a promise that nobody could ever reach it. Our servers store your answers, as the Privacy Policy explains.
- Saved moments. When either of you saves something to Us, it becomes a shared memory. If you unpair, each of you can still open the memories that were saved.
7. Acting decently
Don’t use Duetto to:
- harass, threaten, stalk, shame, control or abuse anyone, including your partner;
- share anything illegal, hateful or sexually explicit, anything involving a child, or anything you don’t have the right to share;
- record or photograph someone who hasn’t agreed to it;
- break, probe or overload our systems, guess other people’s codes, scrape the app, or get around limits;
- pretend to be someone else, or commit fraud or any other offence.
Duetto has no public feed and no chat with strangers. It connects you only to the one person you paired with. If you think someone is breaking these terms, email us.
8. Free, Pro and payments
- Some of Duetto is free. The rest needs Duetto Pro. The app shows what’s included, and the price in your own currency, before you buy.
- Duetto Pro Yearly is an auto-renewing subscription. New subscribers who qualify get a 7-day free trial. Duetto Pro Lifetime is a single payment, with no renewal. Earlier Duetto purchases (monthly Pro and the older packs) still count as Pro.
- One Pro covers both of you. While you’re paired, if either of you has an active Pro purchase, you both get Pro. If you unpair, each of you keeps Pro only if you bought it.
- Apple takes the payment through your Apple Account. We never see your card details. Payment is charged when you confirm the purchase, or when your free trial ends.
- A yearly subscription renews automatically unless you cancel at least 24 hours before the end of the current period, or before the end of the free trial. If you don’t cancel a trial in time, it becomes a paid subscription.
- Manage or cancel in your iPhone’s Settings › your name › Subscriptions. You keep Pro until the end of the period you’ve paid for. Deleting your Duetto account does not cancel a subscription.
- Refunds are handled by Apple, under the App Store’s rules. You can ask at reportaproblem.apple.com. If something’s wrong with Pro in the app, email us and we’ll help.
- If Pro doesn’t show up after a reinstall or on a new phone, tap Restore purchases in Settings.
9. Notifications, and what Duetto isn’t
If you say yes, Duetto sends notifications, for example when your partner answers or takes a turn. You can turn them off in Duetto’s Settings or in iOS. They aren’t made for emergencies.
Duetto is for fun and for getting closer. Its questions and games aren’t therapy, counselling, medical, legal, financial or relationship advice, and they can’t fix a relationship. If you’re struggling, please talk to a qualified professional.
10. Ending things
- You can stop using Duetto and delete your account at any time, in Settings › Privacy and data. The Privacy Policy says what is deleted.
- We can suspend or end your access if you break these terms, put someone at risk, or misuse the service. Where we reasonably can, we’ll tell you why.
- We may change, pause or retire features, games and content. We’ll try to tell you about big changes.
- Duetto depends on the internet, Apple and our cloud provider. We can’t promise it will always be available or error-free.
11. Our responsibility
- Your rights under the Australian Consumer Law. Our goods and services come with guarantees that can’t be excluded under the Australian Consumer Law. If there’s a major failure with the service, you can cancel it and get a refund for the unused part, or compensation for its reduced value. You’re also entitled to compensation for other reasonably foreseeable loss or damage. Nothing in these terms limits those guarantees, or any other consumer right you have where you live that can’t be limited.
- Apart from that, Duetto is provided “as is” as far as the law allows. We aren’t liable for indirect or consequential loss, or for loss of data, profit or goodwill.
- Where the law lets us limit our liability for breaking a guarantee, we limit it, at our choice, to supplying the service again or paying the cost of having it supplied again.
- Nothing here limits liability that the law doesn’t allow to be limited, such as for fraud, or for death or personal injury caused by negligence.
12. Changes to these terms
We may update these terms. If a change matters, we’ll tell you in the app and update the date at the top of this page. If you keep using Duetto after a change takes effect, you accept it. If you don’t agree, you can stop using Duetto and delete your account.
13. Law
These terms are governed by the laws of Australia. If we can’t sort out a problem together, either of us can take it to the courts of Australia. This doesn’t take away any consumer protection that applies to you where you live and can’t be excluded by contract.
